Introduction to Traditional Tribal Governance in Jharkhand

Jharkhand is known for its rich tribal culture and ancient community traditions. Different tribal communities of the region developed their own systems of governance to regulate social life. These institutions existed long before the introduction of modern governmental administration.

Traditional institutions handled village administration, religious observances, social discipline, community resources and local disputes. The titles and functions of office-bearers differed among communities, but most systems were founded on collective responsibility, participation and social harmony.

Important Fact: According to the Government of Jharkhand, the state has 32 tribal groups. Santhal, Munda, Oraon, Ho and Kharia are among its major tribes. Different communities developed distinct systems of governance according to their social and cultural circumstances.

1. Concept of Traditional Self-Governance

Traditional self-governance refers to a community-based arrangement under which the affairs of a tribal village or a group of villages are regulated through customary rules, established traditions and collective consent.

These rules were generally not codified as written laws. They were preserved through community memory, oral traditions and the transmission of knowledge from one generation to another. Their authority arose largely from social acceptance.

Major Features of Traditional Self-Governance

  • It was founded on tribal customs and traditions.
  • The village community served as its basic unit.
  • Decisions were generally taken through collective consultation.
  • Office-bearers could perform administrative, social, religious or judicial functions.
  • Many offices were hereditary, while community acceptance remained important in certain cases.
  • Community welfare and social unity received greater importance than individual interest.
  • Justice aimed at restoring social balance in addition to punishing misconduct.
  • Customary rules regulated the use of land, forests, water sources and other community resources.

2. Village and Regional Administration

Traditional tribal administration in Jharkhand generally operated at two principal levels—the village level and the regional level. Some communities also possessed intermediate institutions.

Village-level Administration

The village was the smallest and most important unit of governance. It normally had a recognised head. Different tribal communities used different titles for their village heads and other functionaries.

The usual functions of village administration included:

  • Convening village meetings.
  • Ensuring observance of social customs.
  • Settling ordinary disputes between individuals or families.
  • Organising collective festivals, worship and cultural activities.
  • Deciding matters connected with community land, forests, grazing grounds and water sources.
  • Maintaining unity and security within the village.
  • Maintaining communication with the higher traditional institution.

Regional Administration

Disputes that could not be settled at the village level, or matters affecting more than one village, were placed before a regional traditional body. Such an institution normally represented a group of villages.

Village heads and other recognised office-bearers participated in regional meetings. These bodies considered inter-village disputes, serious violations of customary rules, boundary-related questions and matters of common interest.

Level Jurisdiction Principal Functions
Village level One village Local administration, social discipline, rituals and ordinary disputes
Regional level A group of villages Inter-village disputes, appeals, serious matters and collective decisions

3. Social, Religious and Judicial Functionaries

Authority was not necessarily concentrated in a single person. Different office-bearers could be responsible for different functions. This created a functional distinction between administrative and religious responsibilities.

Social or Administrative Functionaries

The village head presided over meetings, helped implement community decisions and represented the village. In some systems, assistants, messengers and other functionaries supported the head.

Religious Functionaries

Religious functionaries conducted the worship of village deities and performed rituals connected with agriculture, nature and community festivals. Their position was important because religion, nature and agriculture were closely connected in tribal life.

Judicial Functionaries

Village and regional assemblies also performed judicial functions. The head and other experienced members heard the parties, considered customary rules and delivered a collective decision.

Remember: The titles and powers of traditional functionaries were not identical in every tribe. Manjhi–Pargana, Munda–Manki, Parha-Panchayat and Doklo–Sohor represent distinct systems associated with different tribal communities.

4. Process of Community Decision-making

Community meetings formed the basis of traditional governance. Important village matters were decided after discussion. Elders, family representatives and recognised office-bearers participated in the process.

A community decision generally involved the following stages:

  1. A problem or dispute was reported to the village head.
  2. A meeting of the village assembly or traditional council was convened.
  3. The parties and available witnesses were heard.
  4. Customary rules and earlier practices were considered.
  5. A decision was reached through consultation or collective agreement.
  6. Emphasis was placed on compliance and restoration of normal social relations.

5. Dispute Resolution and Customary Justice

Traditional institutions dealt with disputes concerning marriage, family relations, inheritance, social conduct, land boundaries, community resources and interpersonal conflicts. Ordinary matters were settled at the village level, while serious or inter-village disputes could be referred to a higher regional institution.

The principal objective was to restore peace and repair disturbed social relations. Depending on the community and nature of the offence, measures could include a warning, compensation, a fine, a community feast or another form of social sanction.

Central Principle: Traditional tribal justice generally placed considerable emphasis on reconciliation, compensation, social correction and restoration of community unity.

6. Relationship with Modern Governance

Constitutional administration, courts and Panchayati Raj institutions subsequently expanded into tribal regions. Nevertheless, traditional institutions continue to influence social and cultural affairs in many parts of Jharkhand.

The Fifth Schedule of the Constitution of India concerns the administration of Scheduled Areas and Scheduled Tribes. The Provisions of the Panchayats (Extension to the Scheduled Areas) Act, 1996, commonly known as PESA, gives importance to Gram Sabhas, customary traditions, cultural identity, community resources and traditional methods of dispute resolution in Scheduled Areas.

However, no customary decision stands above the Constitution or applicable law. Serious criminal matters and questions of legal rights fall within the jurisdiction of competent governmental and judicial authorities.
